1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of the Moshan mobile application and related services (the “Services”).

By accessing or using the Services, you agree to be bound by these Terms.

2. Eligibility

You must be at least 18 years old to use the Services. By using Moshan, you represent and warrant that you meet this requirement.

3. Accounts and Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

Business accounts may be shared internally at the business’s discretion. Moshan is not responsible for internal access control or misuse within a business.

4. Platform Role

Moshan provides a digital platform connecting users, businesses, and service providers (including venues). Moshan does not own, operate, manage, or control third-party venues or services and is not responsible for their performance.

5. Subscriptions and Payments

• Certain features require paid subscriptions
• Payments are processed by third-party providers, including Stripe
• Fees are non-refundable except where required by law

6. Acceptable Use

You agree not to:

• Use the Services for unlawful or unauthorized purposes
• Interfere with or disrupt platform security
• Misrepresent your identity or affiliation
• Abuse, harass, or harm other users or service providers

7. Suspension and Termination

Moshan may suspend or terminate access to the Services at any time for violation of these Terms, applicable law, or platform integrity concerns.

Users may terminate their accounts at any time.

8. Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis. Moshan disclaims all warranties, express or implied, to the maximum extent permitted by law.

9. Limitation of Liability

To the maximum extent permitted by law, Moshan shall not be liable for indirect, incidental, consequential, or punitive damages arising out of or related to use of the Services.

10. Indemnification

You agree to indemnify and hold harmless Moshan from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to conflict-of-law principles.

12. Changes to Terms

Moshan may modify these Terms from time to time. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
